Taylor Wessing has published the results of its survey exploring the issues companies face with pensions in restructuring. Regarding whether TPR should be given additional powers in relation to corporate restructurings, only 11% felt that the powers that TPR has are fine as they are. However, no respondents felt there should be fines at fixed levels where TPR uses its “moral hazard powers”, rather than the current broad discretion.

Taylor Wessing has published its Pensions in Restructuring Survey, which reveals that 79% of the trustees and actuaries questioned believe that the system would be simpler and more effective if TPR and the PPF were combined. The survey also found that 46% thought that TPR is uninterested in any engagement with smaller schemes on restructuring.
